Introduction

Cherry Locum Pty Ltd, hereafter referred to as “Cherry Locum” manages personal information collected in line with providing employment services within the healthcare industry. 

Cherry Locum ensures data collection, management and storage is in accordance the Privacy Act 1988 and Australian Privacy Principles.

This policy provides information about information held by Cherry Locum as an APP Entity which continues to apply to after any agreements with Cherry Locum have ceased.

Your Rights

Please be aware that you have the following data protection rights:

  • The right to be informed about the personal data the company processes on you;

  • The right of access to the personal data the company processes on you;

  • The right to rectification of your personal data;

  • The right to data portability in certain circumstances;

  • The right to object to the processing of your personal data that was based on a public or legitimate interest;

  • The right not to be subjected to automated decision making and profiling; and

Type of Information

Personal information collected and held by Cherry Locum is for the explicit purpose of providing employment services. All information collected and held is reasonably necessary for the proper performance of business activities dependant on the function of the stakeholder ie. Candidate, employer or referee.

Sometimes Cherry Locum may collect sensitive information, this information is only collected with your consent and where it is necessary for the performance of employment services.  Sensitive information will need to be collected where it relates to a genuine occupational requirement or an inherent requirement of the job or work being considered.  Our collection of some types of sensitive information is also governed by equal opportunity and anti-discrimination laws.

Candidate

Information collected and held for candidates is required to assess suitability for placements and manage work performance. 

This information includes, but may not be limited to:

  • Contact information 

  • Employment history, skills and qualifications

  • Banking and ABN details

  • Health and immunisation details

  • Information relating to visa details if applicable

  • Information to ascertain work preferences and abilities

Employers

Information collected and held for employers is required to assess job match requirements to meet the needs of the health facility. 

This information includes, but may not be limited to:

  • Contact details

  • Organisation and team structures

  • Position descriptions, role requirements and incident management

  • Financial information such as pay scales and bank details 

  • History of client relationships if applicable

Referees

Information collected and held for a referee is required to assess suitability and verify information for candidates.

This information includes, but may not be limited to:

  • Contact details

  • Authority to provide reference

  • Content of reference report 

Purpose of Information

Information collected and held by Cherry Locum is for the purpose of providing employment services within the health care industry. Information collected and held is used for the below business activities dependant on the function of the stakeholder ie. Candidate, employer or referee.

Direct marketing is used by Cherry Locum via email, phone, sms, online advertisements and printed materials. Unless specifically requested, we do not share personal information but it may be used to tailor appropriate communication to you for the purposes of employment services.

You may opt out of direct marketing communications at any time.

Candidate

Information that is collected and held for candidates is typically used for, but not limited to, the below purposes:

  • Employment placement operations

  • Recruitment functions

  • Statistical purposes and statutory compliance requirements

Employers

Information that is collected and held for employers is typically used for, but not limited to, the below purposes:

  • Employer and business relationship management

  • Recruitment functions

  • Marketing services 

  • Statistical purposes and statutory compliance requirements

Referees

Information that is collected and held for referees is typically used for, but not limited to, the below purposes:

  • Confirmation of identity and authority to provide references

  • Candidate suitability assessment

  • Recruitment functions

How Information is Collected 

The means in which Cherry Locum collects personal information may differ depending on the function of the stakeholder ie. Candidate, employer or referee.

In addition to the below stakeholder interactions, information may be supplied via electronic transactions. 

This includes, but is not limited to the below situations:

  • An individual completes a contact form via our website 

  • An individual contacts us via social media

  • An individual subscribes to our mailing list 

  • An individual contacts us via direct email

Transactions completed with use of the internet may contain risks where appropriate steps should be taken to protect your personal information.

Candidate

Personal information is collected directly from candidates as per business processes when soliciting Cherry Locum for employment services.

Personal information is also collected via the below sources:

  • Reference reports or placement feedback

  • Disciplinary, criminal or medical registration matters

  • Disclosed by the candidate

In addition to the above, information may be collected from third parties and publicly available sources when necessary for a specific purpose such as checking information that has been provided to us or where you have consented or would reasonably expect us to collect information in this way. This includes newspapers, journals, directories and/or social media websites. 

All publicly sourced information is managed in accordance with the APP.

Employer

Personal information is collected directly from the employer as per business processes when soliciting Cherry Locum for employment purposes.

Personal information is also collected via the below sources:

  • Placement feedback

In addition to the above, information may be collected from third parties and publicly available sources when necessary for a specific purpose such as checking information that has been provided to us or where you have consented or would reasonably expect us to collect information in this way. This includes newspapers, journals, directories and/or social media websites. 

All publicly sourced information is managed in accordance with the APP.

Referee

Personal information may be collected when supplied directly to Cherry Locum via:

  • In the course of conducting candidate reference checks

In addition to the above, information may be collected from third parties and publicly available sources when necessary for a specific purpose such as checking information that has been provided to us or where you have consented or would reasonably expect us to collect information in this way. This includes newspapers, journals, directories and/or social media websites. 

All publicly sourced information is managed in accordance with the APP.

How Information is Held

Cherry Locum securely holds personal information until such time as it is no longer required for the any purpose. At which time it may be de-identified or destroyed provided it is lawful for us to do so. 

Cherry Locum’s security of information and systems is maintained to protect personal information from:

  • Misuse, interference and loss, and

  • Unauthorised access, modification or disclosure

All information is held digitally on password protected cloud based software.

Disclosures

Cherry Locum may disclose your personal information for the intent of providing employment services to you or for lawful related purposes. 

Cherry Locum may outsource a number a services to contracted service providers (CSP’s). CSP’s that may have visibility to your personal information include:

  • Software providers

  • IT contractors

  • Internet service providers

  • Legal and other professional advisors

Cherry Locum takes reasonable steps to ensure that terms of service with our CSP’s recognise that they are bound by obligations to protect the privacy of personal information stored and agree to not take any actions that would cause a breach our obligations. 

Access & Correction

Subject to the exceptions as contained in Privacy Law, individuals may gain access to personal information held by Cherry Locum. 

An important exception to access of information rights includes evaluative opinion material obtained confidentially in the course of performing reference checks that may impact the rights of other people. In this scenario, the expected entitlement to confidentiality of the referee will be observed and access will be refused. 

Cherry Locum will take reasonable steps to update personal information as requested if it is inaccurate, out of date, incomplete, irrelevant or misleading. This includes notifying any third parties to whom we have made disclosures unless it is impractical or unlawful to do so.

Complaints

Complaints against Cherry Locum’s handling of personal information should first be made to us in writing at hello@cherrylocum.com.au

Once a written complaint is received, Cherry Locum will follow the below steps:

  1. We will confirm the authenticity of the complaint and provided contact details to ensure that we are responding to the complainant or an authorised person to receive information about the complaint

  2. We will provide written confirmation to acknowledge receipt of the complaint and confirm we are handling the complaint in line with our policies

  3. We may require additional information or clarification around aspects of the complaint

  4. We will investigate the complaint with intent to ascertain what has happened and why

  5. We will reply within a reasonable timeframe with suggested steps to correct

If your complaint cannot be resolved reasonably by Cherry Locum, we suggest that your complaint be escalated to Office of the Australian Information Commissioner or the Recruitment, Consulting and Staffing Association (RSCA).

Please note, the RSCA Ethics process is designed to regulate the conduct of the Associations members and does not constitute a recognised external dispute resolution scheme for the purpose of the APP.

Future Changes

This policy may change over time due to changes to privacy laws, technology and our business practices. If you use our website regularly or conduct transactions with us that involve collection of your personal information, it is important that you check this policy regularly to ensure that you are aware of the extent of any consent, authorisation or permission you might give.
